REGULATION
On the Department of Culture and Archiving
of the ULYANOVSK OBLAST
1. General Provisions.
1.1. Department of Culture and archiving of the Ulyanovsk Oblast (hereinafter -
the Department) is the executive body of state power of the Ulyanovsk Oblast,
headed by the Government of the Ulyanovsk Oblast and established in order to
exercise the authority in the field of culture, art, cinema and archiving.
1.2. The Department is the legal successor of the Administration of Cultural
Affairs and Arts of the Ulyanovsk Oblast and Archives Administration of the
Ulyanovsk Oblast in all the rights and obligations.
1.3. The Department structurally consists of the regional public institutions of
culture, arts, education, cinema and archives, administered by the Department.
1.4. The Department carries out its activities both independently and in
conjunction with the federal executive bodies, executive bodies of the Ulyanovsk
Oblast, Ulyanovsk Oblast municipalities, as well as together with creative
unions, associations and other organizations and citizens in the field of
culture, art, cinema and archiving.
1.5. The activity of the Department is guided by the RF Constitution, Russian
legislation, decrees and orders of the President of Russia, decrees and orders
of the RF Government, the Charter of the Ulyanovsk Oblast, laws and other
normative legal acts of the Ulyanovsk Oblast, and this Regulation.
1.6. The Department is a legal entity; it has a seal of a standard form, as well
as seals, stamps and forms necessary for the functioning of the Department.
1.7. The Department is financed from the regional budget of the Ulyanovsk
Oblast.
1.8. The Department has separate property in the operating management; it can,
on its behalf, acquire and exercise property and personal non-property rights,
bear duties, be a plaintiff or a defendant in court.
The Department has its own balance sheet and accounts opened in accordance with
the RF legislation.
1.9. Location of the Department (legal address): 432011, Ulyanovsk, str.
Sovetskaya, 10.
2. Functions and powers of the Department
2.1. The Department performs the following functions and powers:
2.1.1. manages the relations in the field of culture, art and cinema, including:
manages the public service in the libraries owned by the Ulyanovsk Oblast;
supports museums, institutions of culture and arts, folk arts and crafts (except
the cases stipulated by the RF legislation), cinematography, regional and local
national-cultural autonomy, studying the national languages and other
ethno-cultural subjects in educational institutions;
monitors the granting of subsidies to local budgets from the regional budget of
the Ulyanovsk Oblast in the field of culture.
2.1.2. manages the archiving issues.
2.2. The Department within its competence cooperates:
2.2.1. with the Department of socio-economic development of the regional
Government machinery when implementing the following functions and powers:
socio-economic programming;
socio-economic programming for the long-term
phase;
macroeconomic programming;
regional programming for the long-term phase;
sectoral programming for the long-term phase;
socio-economic programming for the planning year;
general economic programming for the planning
year;
regional programming for the planning year;
sectoral programming for the planning year;
providing the development of the territorial
planning scheme of the Ulyanovsk Oblast and the plan of the scheme
implementation;
management of the investment activity
development;
management of the formation of the state
information resources in accordance to the results of the socio-economic
monitoring.
2.2.2. with the Department of interregional and international relations of the
Government of the Ulyanovsk Oblast when exercising the powers of economic
support, information and cultural communication with the former Soviet Union
states and far abroad countries, including the relations with the compatriots.
2.2.3. with the Ministry of Construction of the Ulyanovsk Oblast for the
implementation of the following powers:
preparation of the territorial planning documentation to define the location of
the capital construction projects of regional significance;
preparation of regional standards for urban planning;
organization and implementation of the state examination of the draft
territorial planning documents and public review of the project documentation.
2.2.4. with the Department of Innovations and Information Technology of the
Government of the Ulyanovsk Oblast when implementing the following functions and
powers:
management of the innovation development;
management of scientific and technical
activities;
informational management;
supervising of formation of public information
resources of the Ulyanovsk Oblast;
supervising of formation of public information resources as according to
the result of the socio-economic monitoring of the Ulyanovsk Oblast;
supervising of formation of departmental information resources of the
Ulyanovsk Oblast;
supervising of development of the state information systems of the
Ulyanovsk Oblast.
2.2.5. with the Ministry of Industry, business and labor resources of the
Ulyanovsk Oblast when implementing the following functions and powers:
support for small businesses;
management of labor in the established order;
regulation of wages, labor relations and
relations that are directly related to labor;
OSH management.
2.2.6. with the Ministry of Finance of the Ulyanovsk Oblast when implementing
the following functions and powers:
management of public finances;
management of the budget process (budget of the
Ulyanovsk Oblast and state extra-budgetary funds);
regulation of inter-budgetary relations.
2.2.7. with the Ministry of State Property and Land Relations of the Ulyanovsk
Oblast when exercising administration of real property (buildings), transport
and equipment owned by the Ulyanovsk Oblast.
2.2.8. with the Ministry of Education of the Ulyanovsk Oblast when implementing
the following functions and powers:
management in the prescribed manner of the
secondary vocational education (except for the federal educational
institutions);
management in the prescribed manner of additional
professional education (except for the federal educational institutions).
2.2.9. with the Service of civil defense, emergency preventing and response and
fire safety of the Ulyanovsk Oblast whenn implementing the following functions
and powers:
management in the field of civil defense,
preventing and response of natural and man-made disasters, fire safety;
management of the arrangement
and implementation of civil defense
activities;
provision of fire safety of the Ulyanovsk Oblast.
2.3. The Department within its competence and in accordance with paragraphs 2.1
and 2.2 of this Regulation:
2.3.1. Establishes, reorganize and liquidate in the prescribed manner the
subordinate institutions.
2.3.2. Studies the needs of the Ulyanovsk Oblast in experts in the field of
culture, art and archiving, coordinates the activities of subordinate
educational institutions and defines the scope and structure of retraining and
advanced training of the experts.
2.3.3. Works out drafts of regulatory legal acts on the matters lying within the
competence of the Department.
2.3.4. Develops and implements regional target programs and departmental target
programs on the development of culture, art and archiving on the territory of
the Ulyanovsk Oblast; participates in the implementation of the relevant federal
programs.
2.3.5. Conducts in due course contests and signs state contracts on the delivery
of goods, implementation of work and services necessary to address the issues
lying within the competence of the Department.
2.3.6. Develops proposals to make the public authorities, local governments and
other organizations more effectively execute the legal acts passed by the
executive authorities of the Ulyanovsk Oblast in the field of culture, art and
archiving.
2.3.7. Organizes timely consideration of citizens’ applications, takes necessary
measures and receives the citizens.
2.3.8. Analyzes the state of culture, arts and archiving, their development
trends and foresees the prospects for their further improvement, informs the
public authorities, local governments, organizations and population of the
region on the issues concerning culture, art and archiving.
2.3.9. Develops and implements economic and social challenges in the field of
culture, art and archiving ssues.
2.3.10. Develops proposals to improve the financing of the subordinate
institutions, organization of labor, wages, social protection of workers of
culture, art and archiving.
2.3.11. Participates in the drafting of the regional budget of the Ulyanovsk
Oblast, ensures the development of estimates of revenues and expenditures for
institutions of culture, art and archiving, funded by the regional budget of the
Ulyanovsk Oblast.
2.3.12. Carries out functions of the main administrator and recipient of funds
from the regional budget of the Ulyanovsk Oblast, provided for the maintenance
of the Department and its subordinate institutions, distributes the limits of
budgetary commitments, prepares and submits to the Ministry of Finance of the
Ulyanovsk Oblast the budgetary reporting (annual, monthly and quarterly) on the
budget execution in accordance with the forms approved by the Ministry of
Finance of Russia.
2.3.13. Makes, in accordance with established procedure, the budget requests for
the subordinate institutions of the Department, monitors the effective use of
budgetary funds.
2.3.14. Contributes to the conservation and development of national cultures,
folk art, the revival of indigenous cultures of small peoples and ethnic
communities in the region.
2.3.15. Contributes to the conservation and development of folk arts and diverse
forms and methods of cultural and leisure activities of the regional population.
2.3.16. Provides in accordance with the RF legislation, state record-keeping,
preservation, restoration, replenishment, use and promotion of public museum
collections in the region.
Provides management of museum objects and museum collections of the regional
property.
Sets the order and conditions of access to the museum objects and museum
collections, kept in the depositories of the regional museums.
2.3.17. Coordinates the library services, regulates the use of funds of
subordinated libraries and ensures their safety.
2.3.18. Manages the subordinate institutions of culture, art and archiving,
conducts documentary audit and inspections of their financial and economic
activities, monitors the expenditure of funds allocated from the regional budget
of the Ulyanovsk Oblast, and effective use of the property.
2.3.19. Develops and submits to the Government of the Ulyanovsk Oblast the plan
of activities aimed at strengthening and developing the material and technical
basis of the subordinate institutions of culture, art and archiving and manages
the supply system of material resources, books and publishing products and
technical means.
2.3.20. Arranges and conducts the activities of mobilization training and
mobilization of the Department, oversees their implementation in the subordinate
organizations and institutions.
2.3.21. Brings the notices of budget allocations to the recipients of the budget
funds.
2.3.22. Cooperates with federal executive authorities in the field of
cinematography.
2.3.23. Provides in accordance with RF legislation, preservation, restoration,
addition, use, promotion and state record-keeping of the documents of Archive of
the Russia Federation, owned by the Ulyanovsk Oblast.
Sets the order and conditions of access to archival documents stored at the
depositary of the regional state archival institutions.
2.3.24. Assists to the non-governmental organizations in addressing the problems
of storage, acquisition and use of Archival Documents of the Russia Federation.
2.3.25. Organizes the research work in the state archives of the Ulyanovsk
Oblast and the introduction of its results.
2.3.26. Develops the scientific criteria for collating the archive fund of
Russia, owned by the Ulyanovsk Oblast, as one of the most important part of
information, historical, cultural and intellectual heritage of the people.
2.3.27. Forms and develops the automated information resources on the
composition and content of the Archive Fund of Russia, owned by the Ulyanovsk
Oblast.
2.3.28. Publishes the documents of the Archive of the Russia owned by the
Ulyanovsk Oblast, of the topical subject-matter.
2.3.29. Prepares proposals on the temporary removal of Archival Documents of the
Russia Federation, owned by the Ulyanovsk Oblast, outside of the Ulyanovsk
Oblast.
2.3.30. Defines together with the owners of archival documents whether these
documents should be added to the Archive Fund of Russia.
2.3.31. Makes decisions concerning the profile of storage of the Archival Fund
documents in the state archives of the Ulyanovsk Oblast.
2.3.32. Signs contracts with the public authorities, local governments and
organizations on mutual cooperation on the issues concerning the establishment
of record keeping services and departmental document storage.
2.3.33. Oversees the compliance with the order of use of archival documents.
2.3.34. Ensures the formation of the register of the unique documents of the
archival fund of the Ulyanovsk Oblast, maintaining the database "Register of the
unique documents of the archival fund of the Ulyanovsk Oblast."
2.3.35. Ensures compliance with the legislation on the state secrets.
2.3.36. Provides protection of state secrets in accordance with the assigned
tasks.
2.3.37. Coordinates the activities of municipalities of the Ulyanovsk Oblast in
the field of culture, art and archiving.
2.3.38. Exercises other powers in accordance with the laws of Russia and
Ulyanovsk Oblast, normative legal acts of the Governor and the Government of the
Ulyanovsk Oblast.
